Website information

Privacy Policy

How we handle information provided through this website and enquiries.

Who is responsible

Etienne Botha Attorneys is responsible for the personal information it processes for enquiries and legal services. Contact Etienne at etienne@botha-attorneys.co.za or +27 83 457 4370. Our offices are at Somerset Links Office Park, Ground Floor, Glen Eagles, De Beers Avenue, Somerset West, Cape Town, and 11 John Annandale Crescent, Onrusrivier.

Information and purpose

We collect the contact details and brief matter description you choose to provide, including an optional court date or deadline. We use this information to assess and respond to your enquiry, check potential conflicts, arrange contact and maintain appropriate records. Information needed for an accepted legal instruction is handled through the practice’s matter processes. Please provide only what is needed at the enquiry stage.

Our approach to processing

We aim to collect relevant information for stated purposes, use appropriate grounds for processing and protect it with reasonable safeguards. Depending on the purpose, processing may be based on consent, steps connected to an instruction, legal duties or legitimate interests. Enquiry consent is not consent to marketing.

Website services

The enquiry form sends submitted details to Formspree for processing and delivery to the practice. Email and WhatsApp links open the service you choose to use. Those providers process information under their own terms. Site hosting and security providers may process technical information such as IP addresses and request logs to deliver and protect the site.

Enquiry processing

Formspree processes form submissions and sends notifications to the practice. Google reCAPTCHA provides spam protection when you choose to load it. No automatic acknowledgement email is currently configured.

Analytics and advertising

Google Analytics 4 is configured to run when analytics is allowed in your cookie preferences. Google Ads and Meta advertising measurement are not currently connected. Measurement is designed to record visits and actions, not names, contact details or matter descriptions. See the Cookie Policy for controls.

Sharing, security and overseas processing

Access is limited to people and service providers who need information for the relevant purpose, or where disclosure is legally required. Providers may process information outside South Africa. Appropriate safeguards and transfer grounds must be established when services are enabled. No online channel is completely secure; use the initial enquiry only for a brief overview.

Retention

The practice’s intended retention period for enquiry and CRM records is five years from the last substantive contact or closure of the enquiry, subject to applicable legal and professional obligations and a lawful basis for retention. Records are reviewed and deleted, de-identified or securely disposed of when no longer lawfully needed. Accepted matter records may follow different professional requirements.

Your choices and rights

You may request access or correction, raise an objection, withdraw consent where applicable, or request deletion where retention is no longer justified. These rights are subject to legal limits. Contact etienne@botha-attorneys.co.za. You may also raise a complaint with South Africa’s Information Regulator.

Review status

This policy may be updated as the practice’s services and procedures change.
